invaliditetom (OSI) i njihove porodice učestvuju u plaćanju usluga socijalne i dječje zaštite. i dječje zaštite ograničava se niz ljudskih prava ove grupe koja su im zagarantovana pomenutim međunarodnim ugovorima\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\", a koja se shodno citiranoj ustavnoj odredbi moraju neposredno primjenjivati. UN-a o pravima OSI nameće obavezu Crnoj Gori da progresivno postigne puno ostvarivanje socijalnih prava OSI (član 4 stav 2), kao i da im omogući \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"članom 58 stavom 1 i 2 Ustava\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" Crne Gore \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"i članom 1 Protokola br. 1 uz Evropsku konvenciju za zaštitu ljudskih prava i osnovnih sloboda\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\". Pored toga,\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\" pravo svojine se \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\"članom 57 Zakona o izmjenama i dopunama Zakona o socijalnoj i dječjoj zaštiti iz 2017. godine \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"ograničava samo licima sa teškim invaliditetom\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\", ali ne i drugim grupama korisnika/ca usluga socijalne i dječje zaštite, \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"čime se prema ovoj grupi vrši neposredna diskriminacija\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\". Stoga je osporena odredba suprotna i \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"članu 8 Ustava \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\"Crne Gore, \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"članu 5 stavu 1 i 2 Konvencije\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"UN-a o pravima OSI, i članu 14 Evropske konvencije za zaštitu ljudskih prava i osnovnih sloboda\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" koji zabranjuju diskriminaciju po bilo kom osnovu. Takođe, ova pravna diskriminacija OSI je \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"suprotna i članu 25 stavu 4 Ustava \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\"Crne Gore, koji čak i u vrijeme ratnog ili vanrednog stanja zabranjuje ukidanje zabrane diskriminacije.\",\"nodeType\":\"text\"}],\"nodeType\":\"paragraph\"},{\"data\":{},\"content\":[{\"data\":{},\"marks\":[],\"value\":\"\",\"nodeType\":\"text\"}],\"nodeType\":\"paragraph\"},{\"data\":{},\"content\":[{\"data\":{},\"marks\":[],\"value\":\"Zbog navedenog \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"osporena odredba je suprotna i članu 68 Ustava \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\"Crne Gore, koji jemči posebnu zaštitu OSI, kao i\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\" članovima 28 i 40 Ustava i\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"članu 8 Evropske konvencije za zaštitu ljudskih prava i osnovnih sloboda\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\", jer lica sa teškim invaliditetom, kojima su potrebne usluge socijalne i dječje zaštite ne mogu ostvarivati svoja ljudska prava na dostojanstvo i nepovredivost ličnosti i privatni i porodični život bez korišćenja ovih usluga. Ljudska prava koja su zagarantovana Ustavom i potvrđenim i objavljenim međunarodnim ugovorima ne mogu se ograničavati nečijim materijalnim stanjem ili ličnim svojstvom, kao što je invaliditet, a naročito se ova ograničenja ne mogu vršiti regresivno, tj. ograničavati već propisani uslovi za ostvarivanje ljudskih prava. The CRPD mandates Montenegro to enable PWDs to \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"italic\"}],\"value\":\"\\\"access to appropriate and affordable services, devices and other assistance for disability-related needs\\\"\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" (Article 28 paragraph 2 point a). \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"The challenged provision is completely contrary to the cited provisions of the CRPD, because it limits the access of PWDs to social and child protection services, providing them at unfavorable and unaffordable prices for this group\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\".\",\"nodeType\":\"text\"}],\"nodeType\":\"paragraph\"},{\"data\":{},\"content\":[{\"data\":{},\"marks\":[],\"value\":\"As Article 32 paragraph 1 of the Law on Social and Child Protection stipulates that \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"italic\"}],\"value\":\"\\\"a person with a severe disability has the right to personal disability allowance\\\"\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\", \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"the challenged provision also limits the right to property of PWDs, which is guaranteed by Article 58 paragraphs 1 and 2 of the Constitution \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\"of Montenegro and \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"Article 1 of the Protocol no. 1 with the European Convention for the Protection of Human Rights and Fundamental Freedoms\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\". Therefore, the challenged provision is contrary to \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"Article 8 of the Constitution\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" of Montenegro, \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"Article 5 paragraph 1 and 2 of the CRPD and Article 14 of the European Convention for the Protection of Human Rights and Fundamental Freedoms\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\", which prohibit discrimination on any basis. This legal discrimination against PWDs is also \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"contrary to Article 25 paragraph 4 of the Constitution\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" of Montenegro, which prohibits the abolition of the prohibition of discrimination even during war or emergency state.\",\"nodeType\":\"text\"}],\"nodeType\":\"paragraph\"},{\"data\":{},\"content\":[{\"data\":{},\"marks\":[],\"value\":\"Because of mentioned, the \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"challenged provision is contrary to Article 68 of the Constitution\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" of Montenegro, which guarantees special protection of PWDs, as well as \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"Articles 28 and 40 of the Constitution\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\" \",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[{\"type\":\"bold\"}],\"value\":\"and Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms\",\"nodeType\":\"text\"},{\"data\":{},\"marks\":[],\"value\":\", because persons with severe disabilities who need social and child protection services cannot realise their human rights to dignity and inviolability of the personality and private and family life without using these services. Human rights, which are guaranteed by the Constitution and confirmed and published international treaties, cannot be limited by someone's material condition or personal characteristic, such as disability, and especially these restrictions cannot be applied regressively, i.e. limit the already prescribed conditions for the realisation of human rights.
